These Terms of Service ("Terms") govern your access to and use of the website and services provided by mayalab.ai ("mayalab.ai", "we", "us", or "our") (the "Service"). By using the Service, you agree to these Terms.

1. Use of the Service

You may use the Service only in compliance with these Terms and all applicable laws. You are responsible for any activity that occurs under your account.

2. AI-Generated Content

The Service uses artificial intelligence to generate outputs. AI outputs may be inaccurate, incomplete, or unsuitable for your purposes and do not constitute professional, legal, financial, or other advice. You are solely responsible for evaluating and verifying any output before relying on it.

3. User Content

If the Service allows you to upload or submit content (images, video, audio, PDFs, text, or other materials) ("User Content"), you represent that you own or have the necessary rights to that content and that it does not infringe any third party's rights and is not unlawful. You retain ownership of your User Content and grant us a limited license to host, store, and process it solely to operate and provide the Service.

4. Copyright Policy and Notices

We respect intellectual property rights and respond to clear notices of alleged infringement, including those made under the United States Digital Millennium Copyright Act (DMCA) where applicable.

If you believe content infringes your copyright, send a notice to [email protected] including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act.

We will remove or disable access to material upon receipt of a valid notice and may terminate accounts of repeat infringers. Responsibility for User Content lies with the user who uploaded it, not with mayalab.ai.

5. Prohibited Conduct

You agree not to upload unlawful, infringing, harmful, or abusive content, or to misuse, disrupt, or attempt to gain unauthorized access to the Service.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, mayalab.ai WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE.

8. Indemnification

You agree to indemnify and hold harmless mayalab.ai from any claims arising out of your User Content or your violation of these Terms.

9. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by final and binding arbitration before a recognized arbitration institution seated in Mexico City, Mexico, rather than in court, except that either party may bring claims in small-claims court where eligible.

Class Action Waiver. You and mayalab.ai agree that disputes will be brought only in an individual capacity, and not as a plaintiff or member of any purported class, collective, or representative proceeding.

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms.

10. Governing Law

These Terms are governed by the laws of the United Mexican States, with jurisdiction in Mexico City, without regard to conflict-of-laws principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
